While many aspects of the United States criminal justice system originated in England, the use of jails and prisons to punish criminals is largely an American invention.
Our American system of justice has evolved from the English common law into a complex series of procedures and decisions. Founded on the concept that crimes against an individual are crimes against the State, our justice system prosecutes individuals as though they victimized all of society.
The following is a condensed account of nearly 400 years of America’s attempts to protect its citizens, punish its criminals, and maintain social order through the enforcement of laws.
To achieve order, governments created criminal laws, developed police systems, and established courts and prisons. Governments funded criminal defense lawyers to represent the indigent in legal proceedings and paid the salaries of judges to apply laws to the case at hand.
In review, the criminal justice system is often viewed as a NON-system because there are three intertwined but segregated divisions. Law enforcement consisted of the police force and focused on crime prevention, crime detection, and apprehending suspects for crimes committed.

The Criminal Justice Act Panel is a group of qualified and court-approved attorneys who are eligible for appointment by the Court to represent individuals in criminal cases who are unable for financial reasons to retain counsel. The defense of necessity may apply when an individual commits a criminal act during an emergency situation in order to prevent a greater harm from happening. The earliest form of punishment was private revenge, in which the victim or the victim’s kin retaliated for injury and the community did not interfere. Policing before 1500
No proper police force existed before the 16th century. It was the responsibility of the victim and local community to find the criminal themselves. It was expected that communities would be responsible for policing and combatting crime.
